Definitions In these terms and conditions ´The Seller´ means SJC Hair & Beauty and ´The Buyer´ means the purchaser of goods from ´The Seller´ under these terms and conditions. We do not supply goods on a ‘Try before you buy’, ‘Trial ’or 'Sale or Return' BASIS! All our products are brand new direct from suppliers and manufacturers. Trade Only SJC Hair & Beauty operates exclusively as a wholesaler; it does not sell directly to the General Public online. It does not deal with online Consumer Sales. All sales are to the Trade. By placing an order with SJC Hair & Beauty’s website you are confirming that you are not a Consumer for the purposes of the Consumer Credit legislation and for the Purposes of Sale of Goods legislation and that you are in business and purchasing the goods for the purpose of that business and not for personal use. All products sold on this website are intended for those qualified in the hairdressing or beauty trade or professions and are for sale on a trade only basis. Customers should be qualified to use the products sold on this website. Goods are sold on the understanding that they will be used for their intended purpose. No responsibility will be accepted by The Seller, for trained or untrained personnel without qualified supervision using or misusing equipment supplied by The Seller. If you are a business customer/owner, it is your responsibility to ensure that you are insured for products that you are using and we reserve the right to ask you to provide proof of professional status and/or relevant qualifications. All manufacturer’s instructions must be read and all relevant skin tests for all applicatory products must be performed before use as we ‘the seller’ does not accept responsibility for any products that we sell or their use /misuse or any adverse results/injuries that occur as a result of their use/misuse by whomever is using them! Liability starts and ends with the buyer. If you are in any doubt or you do not agree with these Terms and Conditions then please do not buy! Prices Prices and special offers are correct at the time of goods being displayed on the website but are subject to alteration without prior notice. Prices are exclusive of VAT at the current rates and delivery costs. VAT is not charged on educational books. It is possible that some of the products in our catalogue may be mispriced at time of print. If a product´s correct price is lower than the stated price on the website, we will charge the lower amount and send you the product. If a product´s correct price is higher than the price stated on the website, we will, at our discretion, either contact you for instructions before despatch, or cancel your order and notify you of such cancellation. Special Offers Please note offer codes or further discounts cannot be applied on any permanent or semi-permanent colour or couch rolls. Offer codes cannot be used in conjunction with any other catalogue or website offers, such as Buy 2 Get 1 Free etc. Exclusions may apply. For all "VAT Free offers" we run, we have reduced the price on all items in the promotion with a discount which is equal to VAT Free. Therefore it is equivalent to not having to pay the VAT. VAT is still applied to the order at the current rate. Offers and promotions run in our online shop and in our catalogue may not be the same as offers run in our physical shop. All offers and promotions are run at The Seller’s discretion. Offers are subject whilst stocks are available and valid for one per customer. Accounts All accounts are strictly 30 day terms from date of invoice and must be paid in full within this time. Any account discounts will be arranged solely at the discretion of SJC Hair & Beauty. Overdue Accounts SJC Hair & Beauty reserve the right that after 30 days a surcharge of 5% of the gross amount will be charged on a daily basis. Your Online Account If you use this website you will be responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under the operation of your account and/or password. You must ensure that the password is kept confidential. If you believe that your password has become known to anyone else, you must inform us immediately. SJC Hair & Beauty reserves the right to refuse any and all access to our website, terminate accounts, and/or cancel orders at our discretion. If we cancel an order you will not be charged. Online Orders We will always do our very best to fulfil all orders placed with us however - We reserve the right to cancel any and all orders which have been placed but remains unpaid or that we deem to be fraudulent, suspicious or unlawful in any way. In these instances the order will be cancelled immediately and notice will be given thereafter. When you place an order to purchase an item from SJC Hair & Beauty, we will send you an email confirming receipt of your order and containing the details of your order. Your order represents an offer to purchase a product which is accepted by us when we despatch that product to you. That acceptance will be complete at the time we despatch the product to you. Any products on the same order which are not despatched do not form part of that contract. Returned Goods If for any reason you are unhappy with your purchase from us then then the following rules will apply before a return can be accepted; NO USED, OPENED, NOT FIT FOR RESALE GOODS WILL BE ACCEPTED FOR RETURN. We have strict rules with regards to hygiene so any goods that have been USED will not be eligible for a return unless they are faulty. All piercing products are non-returnable if seals are broken/item is used only faulty items can be returned. Due to strict hygiene regulations, the Seller cannot accept returns of items such as scissors, clippers, razors, manicure or pedicure implements, tweezers and electrolysis needles which have been used. (This list is not exhaustive).The rules are final and are non-negotiable. If goods have been ordered in error or are not as expected, please contact our Customer Services Department on 0845 643 6188 to request a returns authorisation – here you will be given clear instructions on how to return your item. All relevant references such as name and address and invoice numbers must be quoted on accompanying documentation with your return. All items that are returned to us are thoroughly inspected by our QC department upon arrival, any usage detected will not be refunded. Please see our ‘RETURNS POLICY’ for full details on all aspects of returns and the Distance selling regulations of 2000 for UK customers only. Please note any items that are sent direct from the manufacturer are non-returnable if they are unsuitable. This does not affect your statutory rights. Please be aware, postage will not be refunded for items returned as unsuitable. Damaged Goods We hope that your parcel arrives to you in a good condition. If however your item has been damaged in transit whilst on its journey to you then we need to be notified within 24 hours. We will require photographic evidence of the damaged item and the original packaging that we sent it to you in. We are unable to file a damage claim with our couriers without evidence/proof. If you are unable to provide photographic proof then we will accept the item back in return. The item will need to be returned in cases where a refund is to be issued. All damages are processed at the management’s discretion. Faulty Goods In the unlikely event that your item fails or develops a fault please contact us as soon as possible as many faults can be resolved over the phone. If it is found that the item needs to be returned you must return the faulty item directly to us yourself. When the goods are received our Quality Control Department will inspect and test the product. If it is indeed found to be faulty we will dispatch a replacement item to you or refund you in full depending on your requirements. However we will NOT accept returned goods that have been tampered with, dismantled or a self-repair has been attempted. Order Shortages SJC Hair & Beauty always try our best to fulfil your orders in the rare event that you have a shortage of an ordered item/s please contact us within 24 hours either by phone or by email to sjchairbeauty@hotmail.co.uk to inform us of of the shortage. Goods must be inspected on delivery and all claims for shortages or damages must be reported to The Seller within 24 hours of receipt of goods.. Telephone is quicker and we more often than not can dispatch your missing items the same day if notified before 12pm. Please Note* All parcels are weighed prior to dispatch which gives us a clear indication as to how many items and which products are contained within. REPEATED CLAIMS Unfortunately we have had a few cases where a small minority of buyers have made repeated claims of shortages, lost postal items, non-receipt issues, items not as described, etc... In this event we as a company will fully investigate all claims made. If however we discover that a buyer may be making false claims to obtain goods or more goods then we will report all findings to Paypal & Royal Mail Fraud Investigations teams, the Police, Trading Standards and any and all agencies necessary to resolve any issues or cases raised. WE take these matters very seriously indeed! Delivery The Seller's policy is to despatch goods within 1 business day of receiving an order, however this can vary subject to stock availability. Times quoted are in good faith, but shall not be binding. The Seller can accept no responsibility for transport delays causing late delivery. Some furniture orders may take up to 6-8 weeks for delivery, or up to 14 weeks for special order items. Extra handling charge will be incurred for re-despatched parcels. Orders must be received before 11:00am (UK time) between Monday to Friday, to be dispatched the same working day. Next day delivery is available on request and must be paid for before the item is dispatched. We do not guarantee next day delivery if your order is being shipped direct from our suppliers, or large or heavy items. The Seller can accept no responsibility for transport delays causing late delivery. Next day delivery is only available to mainland UK. Delivery Charges £4.95 plus VAT is the standard delivery charge for most parts of the UK. The Channel Islands, Offshore islands, Highlands, Scottish Islands and certain areas of the UK may vary according to the size and weight of the parcel. Special delivery charges will be quoted on request. This excludes any large or heavy items. Orders placed online over £60, excluding VAT, to most parts of mainland UK have free delivery. This excludes any large or heavy items. Free delivery over £60 does not apply to orders where a promotional discount has been applied. Large and Heavy Items Please ask for carriage charges on large furniture items. This list is varied and not exhaustive. Cancellations Prior to despatch, non-standard items such as furniture/special order items, cannot be cancelled. Cancellation after despatch cannot be accepted. Product Availability All products are subject to stock availability. Stock availability is shown on the website, however if we have insufficient stock to fulfil the order, we will notify you by e-mail at the address given by you in your registration form. Stock is allocated on a first come first served basis once your order reaches our main server. The Seller doesn´t guarantee the availability of any item based on stock figures shown as these change constantly. Web Content All content included on the website is the property of SJC Hair & Beauty or our suppliers. All software used on this website is the property of SJC Hair & Beauty or our software suppliers. You may not extract or reutilise part of the contents of the website without the written consent of SJC Hair & Beauty. Neither this website nor any part of it may be reproduced, duplicated, copied, sold, re-sold, visited or otherwise exploited for any commercial purpose. No domain names, brand names or trademarks owned by the seller may be copied or reproduced without the express permission of SJC Hair & Beauty. SJC Hair & Beauty will grant customers limited licence to access and make personal use of this website, but not to download (other than page caching) or modify it, or any portion of it except with the written consent of SJC Hair & Beauty. This licence does not include any resale or commercial use of this website or its contents, any downloading or copying of account information for the benefit of another seller and /or company. Force Majeure SJC Hair & Beauty shall be entitled to cancel or delay delivery of orders if it is delayed, hindered or prevented from delivery through circumstances beyond its control. Such circumstances shall include (but are not limited to) industrial action, accident, fire, Acts of God or failure to deliver by suppliers or carriers. General All offers are subject to stock availability. The Seller reserves the right to restrict or refuse any order for application of credit at any time. The Seller takes special care to show accurate sizes and specifications with all such descriptions, whilst given as a guide, in good faith, are subject to alteration by The Seller without notice. All colours of our images are as near to the original item as can be displayed on a computer monitor – this will also depend on your computer/monitor screens resolution or HD. Call Monitoring In order to maintain the highest standards of customer service and to help with the training of new staff, we sometimes monitor and record incoming telephone calls. Please note when contacting us we will do all we can to help you with any enquiry you may have however we do reserve the right to refuse help and advice to those who are rude and/or abusive to staff on the phone, via email and or in face to face contact - VERBAL / PHYSICAL ABUSE WILL NOT BE TOLERATED AND POLICE INTERVENTION WILL BE CALLED UPON. All glass items and body and ear piercings are specifically excluded from this guarantee. Jurisdiction These terms and conditions and all contracts entered into under them are governed by and are to be construed in accordance with the laws of England and Wales. You agree to submit to the jurisdiction of the Courts of England and Wales in relation to any contract entered into under these terms and conditions. Retention of Title Clause 1. The risk in all goods passes to The Buyer upon delivery but title in the goods remains vested in The Seller and shall only pass from The Seller to The Buyer upon full payment being made of all sums (due on whatsoever account or grounds) to The Seller. The Buyer agrees, prior to the payment of the whole price of the goods, The Seller or appointed agents may enter The Buyers premises to collect such goods should The Seller request. Prior to such payment, the Buyer shall keep the goods separate and identifiable for the purpose and return the goods to The Seller should The Seller request.
